## Booking Terms & Conditions
### 1. Acceptance of Terms
By making a booking with The Curated Collection Pty Ltd (“TCC”), you acknowledge and agree that these Terms & Conditions apply to all guests occupying the property during the booking period.
The person making the booking is responsible for ensuring all occupants and visitors comply with these Terms & Conditions.
This agreement is for short-term holiday accommodation only and is not a Residential Tenancy Agreement under any residential tenancy legislation.
Failure to comply with these Terms & Conditions may result in immediate termination of the booking without refund.
A booking is not confirmed until:
– A deposit has been paid;
– A booking agreement has been completed;
– Guest identification requirements have been satisfied; and
– These Terms & Conditions have been accepted.

## 2. NSW Short-Term Rental Accommodation Code of Conduct
Guests occupying properties located in New South Wales must comply with the NSW Fair Trading Code of Conduct for the Short-Term Rental Accommodation Industry.
Guests must:
– Act lawfully at all times;
– Respect neighbours and surrounding properties;
– Not create excessive noise or disturbances;
– Not engage in anti-social, threatening or violent behaviour;
– Not damage property, common areas or neighbouring premises;
– Ensure all visitors comply with these obligations.
Any breach of the NSW Code of Conduct may result in immediate termination of the booking without refund and may be reported to the relevant authorities.

## 3. Payments and Security Deposits
All funds are held in a regulated Trust Account.
### Deposit
A deposit equal to 50% of the total accommodation cost is required at the time of booking.
### Final Payment
The remaining balance, including any applicable security deposit, is due thirty (30) days prior to arrival.
### Security Deposit
A security deposit may be held by way of:
– Credit card pre-authorisation;
– Cash bond;
– Platform bond arrangement; or
– Any other security method nominated by TCC.
The guest online check-in process must be completed no later than seven (7) days before arrival.
Failure to complete the required documentation may result in cancellation of the booking, with all monies forfeited.
Security deposits may be applied toward:
– Property damage;
– Breakages or missing items;
– Excess cleaning;
– Smoking remediation;
– Unauthorised guests;
– Unauthorised pets;
– Security call-out fees;
– Lockout charges;
– Excess rubbish removal;
– Additional linen or laundry costs;
– Administrative costs associated with breaches of these Terms.
Security deposits are generally released within fourteen (14) days of departure, subject to inspection of the property.

## 4. Cancellation by Guest
### More than 90 Days Prior to Arrival
Guests will receive a refund of monies paid less:
– A cancellation fee of $150; and
– Any merchant or transaction fees incurred.
### Within 90 Days of Arrival
No refund will be payable unless the cancelled booking dates are re-booked.
Where replacement bookings are secured, refunds will be limited to the value recovered less:
– Any loss in rental income;
– Cancellation fee of $150;
– Merchant fees incurred.
Guests are strongly encouraged to obtain travel insurance.

## 5. Cancellation by The Curated Collection
Occasionally circumstances beyond our control may make a property unavailable.
Examples include:
– Flood;
– Fire;
– Storm damage;
– Bushfire risk;
– Safety concerns;
– Government restrictions;
– Sale of the property;
– Owner withdrawal from the holiday rental market;
– Utility failures or major maintenance issues.
In such circumstances TCC may:
– Offer alternative accommodation;
– Transfer the booking to another property; or
– Refund monies paid.
TCC’s liability is limited to the refund of monies paid and no further compensation shall be payable.

## 6. Travel Insurance
Guests are strongly encouraged to obtain comprehensive travel insurance covering:
– Cancellation;
– Illness;
– Injury;
– Travel disruption;
– Weather events;
– Loss of personal belongings.
Failure to obtain travel insurance does not entitle a guest to any refund outside these Terms & Conditions.

## 7. Occupancy and Use of Premises
The number of occupants must not exceed the number specified on the booking confirmation.
All guests must be disclosed prior to arrival.
Visitors are not permitted without prior written approval from TCC.
The property must only be used for residential holiday accommodation purposes.
Commercial use, events, parties, weddings, photo shoots, content creation, filming or functions are prohibited unless expressly approved in writing.

## 8. Property Care and Guest Responsibilities
Guests agree to:
– Keep the property reasonably clean and tidy;
– Report any damage immediately;
– Use fixtures and appliances responsibly;
– Leave the property in a tidy condition upon departure.
Guests must:
– Wash dishes;
– Empty the refrigerator;
– Remove rubbish to designated bins;
– Lock all doors and windows upon departure.
Additional cleaning charges may apply where excessive cleaning is required.

## 9. Property Condition and Maintenance
Whilst every effort is made to ensure properties are presented in excellent condition, occasional equipment failures may occur.
TCC cannot guarantee uninterrupted operation of:
– Air-conditioning;
– Heating;
– Appliances;
– Internet services;
– Television services;
– Electricity;
– Water;
– Plumbing systems.
Where issues arise, reasonable efforts will be made to arrange repairs as quickly as possible.
No refunds or compensation shall be payable for temporary interruptions beyond our reasonable control.

## 10. Noise, Parties and Anti-Social Behaviour
Excessive noise, parties, functions and anti-social behaviour are strictly prohibited.
Breaches may result in:
– Immediate termination of the booking;
– Forfeiture of the security deposit;
– Additional cleaning or repair charges;
– Security attendance charges.
Unauthorised events, commercial gatherings or functions may incur additional charges of up to $5,000 plus associated costs.

## 11. Noise Complaints
If a complaint is received:
1. Guests will be contacted directly.
2. If unresolved, security personnel may attend.
3. Security call-out fees will be charged to the guest.
Repeated complaints may result in immediate eviction without refund.

## 12. Check-In and Check-Out
Standard check-in time: 2:00pm
Standard check-out time: 10:00am
Early check-in and late check-out requests are subject to availability and cannot be guaranteed.
Additional fees may apply.

## 13. Keys and Access Devices
Guests are responsible for all keys, remotes, access cards and security devices provided.
Charges will apply for:
– Lost keys;
– Lockouts;
– Replacement remotes;
– Re-keying locks;
– Locksmith attendance.
Guests must not copy keys or retain access devices after departure.

## 14. Internet Services
Internet access is provided as a convenience only.
TCC cannot guarantee:
– Connection speed;
– Reliability;
– Continuous service availability.
Guests requiring guaranteed internet for work or business purposes should arrange their own backup internet services.

## 15. Smoking
Smoking and vaping are prohibited inside all properties.
Evidence of smoking may result in:
– Additional cleaning charges;
– Odour removal charges;
– Bond deductions.

## 16. Pets
Pets are only permitted at approved pet-friendly properties and where approved in writing.
Guests are responsible for ensuring pets:
– Are clean and well groomed;
– Are treated for fleas and ticks;
– Are not left unattended;
– Do not damage furnishings, lawns or gardens;
– Do not create nuisance noise.
Any damage, cleaning or pest treatment costs associated with pets will be charged to the guest.

## 17. Swimming Pools, Waterfronts and Safety
Guests acknowledge that many properties contain features including:
– Swimming pools;
– Waterfront access;
– Jetties;
– Stairs;
– Balconies;
– Retaining walls;
– Steep terrain;
– Fireplaces;
– Outdoor entertaining areas.
These features carry inherent risks.
Guests assume responsibility for supervising children and vulnerable persons at all times and use such facilities entirely at their own risk.

## 18. Security Cameras
Some properties may have external security cameras monitoring driveways, entrances, gates or external areas.
No internal living spaces are monitored.
Guests acknowledge and consent to the operation of disclosed external security devices.

## 19. Fire Safety
Guests must not interfere with:
– Smoke alarms;
– Fire extinguishers;
– Emergency equipment;
– Evacuation plans;
– Safety systems.
Any resulting costs may be deducted from the security deposit.

## 20. Right of Entry
TCC, property owners or authorised contractors may access the property where reasonably necessary for:
– Emergencies;
– Repairs;
– Maintenance;
– Safety concerns;
– Complaint investigations.
Reasonable notice will be provided where practical.

## 21. Lost Property
TCC accepts no responsibility for items left behind.
Where possible, lost property may be returned at the guest’s expense.
Items not claimed within thirty (30) days may be disposed of.

## 22. Photography and Property Representation
Property photographs are intended as a general representation only.
Furnishings, artwork, appliances, bedding, décor and amenities may vary from those shown in marketing materials.
Such variations do not constitute grounds for cancellation or compensation.

## 23. Limitation of Liability
The Curated Collection acts solely as agent for the property owner.
To the maximum extent permitted by law, TCC shall not be liable for:
– Personal injury;
– Loss of enjoyment;
– Loss of income;
– Travel disruption;
– Utility outages;
– Internet failures;
– Weather events;
– Natural disasters;
– Acts of third parties;
– Loss or theft of personal belongings;
– Circumstances beyond its reasonable control.
Nothing in these Terms excludes rights that cannot lawfully be excluded under Australian Consumer Law.

## 24. Chargebacks and Payment Disputes
By making a booking, guests authorise TCC to provide booking records, correspondence, signed agreements, payment records, identification documents and stay records to financial institutions, booking platforms and dispute resolution bodies in connection with any chargeback or payment dispute.

Personal information will be handled in accordance with TCC’s Privacy Policy.

## 26. Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia.
Any disputes shall be subject to the non-exclusive jurisdiction of the Courts of New South Wales.

## 27. Acceptance
By making payment, completing the booking process or occupying the property, guests acknowledge that they have read, understood and accepted these Terms & Conditions.
